Welcome to It's Out Now. These terms explain how the platform works and what we expect from each other. By using the service, you're agreeing to them.

Using the Service

By creating an account and using It's Out Now, you agree to these terms. If something here doesn't work for you, please reach out before using the platform - we'd rather work something out than have you agree to terms you're not comfortable with.

What We Provide

It's Out Now gives independent artists and their teams tools to manage and track music releases: Release links and private listening portals Analytics showing who accessed your link and how they engaged Email capture and fan data collection Marketing tools for releases We're always working on the platform. Features may be added, changed, or retired over time - we'll do our best to give you notice for anything significant.

Your Account

You're responsible for keeping your login credentials secure and for any activity that happens under your account. Please give us accurate information when you sign up. If you think your account has been compromised, contact us straight away. We reserve the right to suspend or close accounts that are misused.

Acceptable Use

We ask that you use the platform responsibly. You agree not to: Break any laws or regulations Upload content you don't have the rights to Attempt to access another user's data or account Interfere with the security or integrity of the platform Use the service to send spam or engage in deceptive practices If you're unsure whether something is okay, just ask.

Your Content

You own everything you upload - your music, artwork, and metadata remain yours. By uploading content, you grant us permission to host, process, and display it as needed to deliver the service. You confirm that you hold the rights to everything you upload and that sharing it through our platform doesn't infringe anyone else's rights.

Data and Analytics

Tracking link activity is core to what It's Out Now does. When someone opens your link, we record the event - listening behaviour, downloads, and contextual metadata like timestamps and device type. If you use our tools to collect data from fans or contacts, you're responsible for having a lawful basis to do so and for complying with applicable privacy laws. Our Privacy Policy explains more about how we handle data.

Cookies

We use cookies and similar technologies to keep the service working properly. By using It's Out Now, you agree to our use of cookies as described in our Privacy Policy.

Third-Party Connections

If you connect Google or another third-party service, you authorise us to access the data necessary to make that integration work. We request only what we need, and we handle that data in line with our Privacy Policy.

Payments

Some features require a paid subscription or one-off payment. Pricing is shown clearly before any purchase. Payments are generally non-refundable unless required by law. We'll give you reasonable notice of any pricing changes.

Service Availability

We aim for high availability and put a lot of care into keeping the platform reliable. That said, we can't guarantee the service will be available at all times - maintenance, third-party outages, and unexpected events do happen. We're not liable for downtime or link failures caused by external services like DSPs or hosting providers.

Liability

To the extent permitted by law, we're not liable for indirect losses, lost revenue, lost data, or reputational damage arising from your use of the service. Our total liability is capped at the amount you've paid us in the 12 months preceding the claim. Nothing in these terms limits liability that can't be excluded under New Zealand law.

Ending the Relationship

You can stop using It's Out Now at any time. If you'd like us to delete your account and data, contact us and we'll take care of it. We may suspend or terminate your access if you breach these terms, if we're required to by law, or if we need to protect the platform or other users. Where possible, we'll give you notice and a chance to resolve the issue first. On termination, your content will be removed from the platform within a reasonable timeframe, except where we're required to retain it by law.

Disputes

If you have a concern or complaint, please contact us first - we'd genuinely like the chance to resolve it. Reach us at hello@itsout.now. If we can't reach a resolution, these terms are governed by New Zealand law and any disputes will be subject to the jurisdiction of New Zealand courts.

Changes to These Terms

We may update these terms from time to time. If we make significant changes, we'll let you know in advance - by email or through the platform. Continuing to use the service after changes take effect means you accept the updated terms.
